Flowly Pro is provided by Luke Young, trading as Flowly ("we", "us", "our"), and the person or business signing up to use it ("you", "your", "the Customer").
Flowly Pro is a subscription software service for garages and mechanics to manage jobs, quotes, invoicing, customer and vehicle records, vehicle registration lookups, digital health checks, and text message reminders. It is provided as a hosted, online service accessed through a web browser.
Flowly Pro is separate from Flowly Mechanic Standard, a one-time-purchase offline product. These terms apply only to Flowly Pro.
You must be at least 18 years old and have the authority to enter into these terms on behalf of yourself or the business you represent. Flowly Pro is intended for use by garages, mechanics, and similar automotive service businesses.
New subscriptions include a 14-day free trial. Your payment card is collected at signup but not charged during the trial. If you do not cancel before the trial ends, your card will be automatically charged the subscription price and your subscription will continue on a rolling monthly basis. We will send a reminder email 7 days before the trial ends, through our payment provider Stripe, so the first charge is never a surprise.
The subscription price is shown to you at signup and billed monthly in advance until cancelled. We may offer discounted pricing to early or founding customers at our discretion; where we do, we intend to honour that price for as long as the relevant subscription remains active and continuous.
We may change the standard subscription price for new subscribers at any time. If we ever change the price for existing subscribers, we will give at least 30 days' notice by email before any new price takes effect.
You may cancel your subscription at any time from within the app. Cancellation takes effect at the end of your current billing period. You will keep access until then, and you will not be charged again after that period ends. We do not provide partial refunds for the unused portion of a billing period.
Refunds are not provided automatically but may be considered on a case-by-case basis, particularly during the first billing cycle after a trial converts to a paid subscription. To request one, contact us using the details in Section 18.
How we collect, use, and protect your data, and your customers' data, is set out in our separate Privacy Policy. By using Flowly Pro, you also agree to that policy.
In relation to your own customers' personal data (names, contact details, vehicle information, and similar) that you store or process using Flowly Pro, you are the data controller and we act as a data processor on your behalf, as set out in our Data Processing Agreement.
Flowly Pro allows you to send certain text messages to your customers, including MOT and service reminders and vehicle-ready notifications.
You are responsible for obtaining valid consent from your customers before enabling MOT or service reminder text messages for them. Flowly Pro provides a consent record feature for this purpose, but the decision to mark a customer as having consented, and the accuracy of that decision, is yours. We are not responsible for your compliance with applicable direct marketing law (including UK PECR) in how you use this feature.
Message credits included in your subscription, and any additional credits purchased, are described in the app and may be updated from time to time. Unused credits do not roll over between billing periods unless stated otherwise in the app.
You agree not to use Flowly Pro to:
We may suspend or terminate accounts that breach this section.
You are responsible for maintaining the confidentiality of your account access and for all activity that occurs under your account. You agree to provide accurate information when setting up your account and to keep it up to date.
Flowly Pro, including its software, design, and branding, is owned by us. You retain full ownership of the business data you enter into it (customer records, job records, and similar). We do not claim ownership of your data and will not use it other than to provide the service to you.
We aim to keep Flowly Pro available and reliable but do not guarantee uninterrupted access. We may need to carry out maintenance or make changes to the service from time to time. We are a small, actively developed product, and features may be added, changed, or improved over time.
To the extent permitted by law, our total liability to you arising from your use of Flowly Pro is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential losses, including loss of profit or loss of business, arising from your use of the service.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or anything else that cannot be excluded by law.
We may suspend or terminate your access to Flowly Pro if you breach these terms, including the acceptable use provisions in Section 10. Where reasonably possible, we will give you notice and an opportunity to resolve the issue first.
We may update these terms from time to time. If we make material changes, we will notify you by email before they take effect.
